Terms of use
These terms apply to the Ondalo app, by Curly Idea, Lda. By using the app, you accept them. In particular, they explain where stations come from and who owns them.
The service
Ondalo is the digital equivalent of a radio receiver. It is an index of radio stations that makes it easy to find and listen to broadcasts that the broadcasters themselves make publicly available on the internet. The station list comes from the open, public radio-browser.info directory.
Ondalo is not a broadcaster
Ondalo is not a broadcaster and does not host, store, record, rebroadcast or alter any stream. When you pick a station, the app connects your iPhone directly to the public stream address that the broadcaster itself makes available (for example on its own website or web player), just as a web browser or a radio set would. The audio is delivered by the servers of the broadcaster or its streaming provider, not by Ondalo. Ondalo is only an intermediary that connects listeners to radio stations broadcasting over the internet.
Third-party rights and intellectual property
Each station's name, trademarks, logo, programmes, music and other content ("third-party content") belong to its broadcaster and rights holders and may be protected by copyright and other rights. Ondalo does not own any of the brands it lists, claims no rights in the content listeners access, and is not a partner of those stations unless stated otherwise.
Ondalo has no editorial or programming control over third-party content, does not endorse it and is not responsible for it. Broadcasters may change, interrupt or withdraw their streams at any time, so we can't guarantee that any station is available. You may not reproduce, record, redistribute or publicly perform third-party content without the rights holder's permission, except where the law allows it.
Ondalo respects third-party rights and complies with applicable law. Intellectual property infringement is not tolerated on the service.
Takedown requests (rights holders)
If you hold the rights to, or represent, a broadcaster and believe a station or content listed in Ondalo infringes your rights, or you simply prefer the station not to appear in the app, send a notice to [email protected]. For the notice to be handled, include at least: the station or content concerned (and its stream address, if you have it); your name and relationship to the rights holder, with a physical or electronic signature of a person authorised to act on their behalf; and contact details for our reply (email, phone or postal address). Once we receive a valid notice, we remove the station from Ondalo within 48 hours. You can also write to Curly Idea, Lda, Lisbon, Portugal (attention: Ondalo, copyright). The email address is also in the app, under Settings › About.
Free version and ads
The free version includes short audio ads. The station pauses for the ad and then comes back live.
Ondalo Premium
Premium removes the ads. It is available as a monthly or yearly subscription, which may start with a 7-day free trial if you're eligible, or as a one-time Lifetime purchase. Payment is charged to your Apple Account when you confirm the purchase or, with a free trial, when the trial ends. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your Apple Account settings. Refunds are handled by Apple under App Store rules.
Acceptable use
Use the app for personal, non-commercial listening only. Don't try to copy, modify, resell or get around the app's protections.
Liability
The app is provided as is. We do our best to keep it working well, but we can't guarantee it will always be available or error-free. Nothing in these terms limits rights you have under consumer law.
Notice for Apple users
These terms are between you and Curly Idea, Lda, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support, and is not responsible for handling claims about the app, including third-party intellectual property claims; those should be sent to us as described under takedown requests.
Privacy
How we handle data is described in our privacy policy.
Governing law and contact
These terms are governed by Portuguese law. For any question, email [email protected]. If this version and the Portuguese one differ, the Portuguese version prevails.
